Transitioning to the WHS Act – Part 1

Once again we are going to plunge into the world of the new health and safety legislation because whether the WHS Act has commenced in your jurisdiction or not, you need to know about it, understand it and do something about it.
Last week we talked about transitioning over to the new model codes of practice but today we will talk about transitioning from individual State health and safety legislation over to the WHS Act and Regulations. Safe Work Australia has developed transitional principles to coordinate the adoption of the new regime across all jurisdictions.

It is highly recommended that if you are a duty holder under health and safety legislation, you use the codes of practice developed by Safe Work Australia to comply with your statutory obligations.
In Wednesday’s OH&S Bulletin we discussed what the model codes of practice are and how they can help you. Today we will look at how to interpret them and tell you about the transitioning approach that your WHS regulator is going to use to help you get used to your new obligations.
Codes of Practice – What they are and why you should use them

Safe Work Australia has developed codes of practice which support the new WHS Act and Regulations. These are largely based on existing codes and guidelines that supported the previous health and safety legislation.
For people who have health and safety duties under the WHS Act, the model codes of practice aim to make it as easy as possible for those people to understand what they need to do to comply with their duties.
